Provisions on Applying for Exhibition Certificate of the World Exposition Shanghai China 2010

For the purpose that its works of invention-creation first exhibited at The World Exposition Shanghai China 2010 (hereinafter “Expo 2010”) will not lose their novelty during the patent application in China or other countries, or the trademark first used for its exhibit (or service) will enjoy the right of priority in filing an application for registration in China or other countries according to relevant laws, the exhibitor of participant of Expo 2010 (including relevant natural person, legal person or organization, hereinafter “the exhibitor”) may, in conformity to Special Regulation No.11: Intellectual Property Rights,submit an application pursuant to the following requirements. The Organizer will issue the Exhibition Certificate of the World Exposition Shanghai China 2010 to those qualified. (hereinafter “the Exhibition Certificate”;see Annex I).
1. Contents of the Exhibition Certificate
1.1 The Exhibition Certificate, issued by the Organizer of Expo 2010, includes text and annexes, both affixed with the official seal of the Organizer.
1.2 The text covers the name of the exhibitor’s works of invention-creation or its exhibit (or service) with the trademark involved, date and location of the first exhibition at Expo 2010, etc.
1.3 The annexes include open information on the concerned exhibit (or service) at Expo 2010.
2. Qualifications for the Exhibition Certificate
The exhibitor with non-patented works of invention-creation first exhibited at Expo 2010 or trademarks first used for their exhibits (or services) at Expo 2010 is entitled to, upon authorization of the Commissioner General of Section or his/her authorized representative of the participant it belongs to, apply for the Exhibition Certificate.
3. Procedure of Exhibition Certificate Application
3.1 The exhibitor shall submit the following documents:
The exhibitor or its agent shall submit the following application documents to the Participants Intellectual Property Service Center of Expo 2010 in the Participants Service Hall (hereinafter “the Service Center”) at least 15 days prior to the first day of exhibition at Expo 2010 of the concerned exhibit (or service). In case of any submission later than the deadline, the Organizer will take the date of on-site verification as the first day of exhibition recorded in the Exhibition Certificate. Details of exhibition will be identified through on-site verification.
3.1.1 The Application Form for Exhibition Certificate of the World Exposition Shanghai China 2010 (hereinafter “the Application Form”, see Annex II) and Application Specification (see Annex III) completed in Chinese, affixed with the signature/seal of the Commissioner General of Section or his/her authorized representative. A photocopy of the Letter of Authorization is required for the signature/seal by the authorized representative. The Application Form and the Application Specification can be downloaded from the Expo Website (www.expo2010.cn) or obtained in the Participants Service Hall. The blank forms may be photocopied;
3.1.2 Open information on concerned exhibits (or services) at Expo 2010 (including but not limited to publicity materials and specifications) in triplicate;
3.1.3 Photocopy of the exhibitor’s registered ID (including but not limited to ID card, passport, Business License);
3.1.4 Original copy of the Letter of Authorization and photocopy of the agent’s registered ID are required for application by an authorized agent.
The above documents shall be in Chinese, or with a Chinese translation offered. All the documents (including the translation) shall bear the signature/seal of the exhibitor. The exhibitor shall also provide electric versions of the documents on CD (in PDF or WORD format).
3.2 Issuance of Application Receipt
The Service Center will issue Application Receipt (see Annex IV) for application meeting the format requirements. For the disqualified ones, the exhibitors shall modify or supplement the documents and file the applications again to obtain the Application Receipt.
3.3 On-site verification by the Organizer
The Organizer will carry out an on-site verification on the declared exhibit (or service) on the first day of exhibition at Expo 2010 and complete the On-site Verification Record (see Annex V). The participants shall provide convenience to the Organizer in terms of easy access, photographing and availability of necessary documents.
3.4 Issuance of the Exhibition Certificate
For the exhibitor offering qualified documents and passing the on-site verification, the Organizer will issue the Exhibition Certificate within one month upon the first day of exhibition of concerned exhibit (or service). The exhibitor or its agent shall inquire with and obtain the Exhibition Certificate from the Service Center by presenting the Application Receipt. The Organizer may, upon the application of the exhibitor, issue the Exhibition Certificate in multiple copies, each copy with the same text and equal effect.
4. Cost for the Exhibition Certificate
To facilitate the exhibitor’s protection of its intellectual works and ease its burden as much as possible, the Organizer will issue one copy of Exhibition Certificate to each exhibitor for free. For more than one copy, the exhibitor shall apply to the Organizer in written form and pay RMB100 for each copy of the Exhibition Certificate other than the first copy.
5. Application rejection and revocation of the Exhibition Certificate
5.1 In case that the exhibitor has any dispute with other natural person, legal person or organization over intellectual property or is investigated by any competent authority on issues related to intellectual property, the Organizer is entitled to discontinue or reject the issuance of the Exhibition Certificate.
5.2 The Organizer may reject the issuance of the Exhibition Certificate if the exhibitor’s application is not qualified and may issue the Notice on Not Issuing Exhibition Certificate (see Annex VI) upon the exhibitor’s request.
5.3 In case that the Exhibition Certificate is obtained by deception or other improper means, the Organizer has the right to revoke the Exhibition Certificate. Concerned participant and exhibitor shall cooperate to facilitate the procedure.
6. Disclaimer
The Exhibition Certificate only certifies the facts about the said exhibition of the exhibit (or service) rather than the authenticity of the document contents, the intellectual works involved or any other legal facts. The concerned participant and exhibitor shall settle by themselves any disputes related to or arising from the Exhibition Certificate, for which the Organizer bears no legal liabilities.
The provisions may be used as reference for UBPA and corporate participants, as well as Hong Kong, Macau and Taiwan.
