Provisions on Applying for Performance Certificate of the World Exposition Shanghai China 2010

In conformity to Special Regulation No.11: Intellectual Property Rights, the Organizer will issue Performance Certificate to artists of official participants for their performances in the Expo Site during Expo 2010. This document aims to offer provisions on issues related to the application for the Performance Certificate of the World Exposition Shanghai China 2010 (hereinafter “the Performance Certificate”;see Annex I). The Performance Certificate shall not replace works registration or other measures concerning intellectual property protection.
1. Contents of the Performance Certificate
The Performance Certificate, issued by the Organizer for performances in the Expo Site (both indoor and outdoor) during the Expo 2010, includes text and annexes, both affixed with the official seal of the Organizer.
The text covers the name of the performer and the name, time and venue of the performance. The performer refers to performing troupe or individual performer involved in the on-site performance.
The annexes include the lists of programs and corresponding artists.
2. Principles for Performance Certificate Application
2.1 “One Performance Certificate for each performance” Principle
The forms of performance may be music, drama, dance, acrobatics, magic, circus, folk arts, puppet, shadow puppet, recitation, etc. A performance may be in one form or a combination of several forms. Regardless of the number of sessions, a performance shall only apply for one Performance Certificate.
2.2 “One application for each performance” Principle
The application for Performance Certificate shall be submitted by the performance organizer, and only one application need to be submitted for each performance. The performance organizer refers to the participant responsible for the performance in the Expo Site.
3. Procedure of Performance Certificate Application
3.1 The participant shall submit the following documents:
The participant shall submit all the required application documents to the Participants Intellectual Property Service Center of Expo 2010 in the Participants Service Hall (hereinafter “the Service Center”). Considering several sessions for one performance during a specific period of time, the documents shall be submitted after the debut at Expo 2010, but 15 days prior to the last show.
3.1.1 The Application Form for Performance Certificate of the World Exposition Shanghai China 2010 (hereinafter “the Application Form”; see Annex II) completed in Chinese. The Application Form can be downloaded from the Expo Website (www.expo2010.cn) or obtained in the Participants Service Hall. The blank forms may be photocopied;
3.1.2 Lists of programs and corresponding artists in triplicate;
The above documents shall be in Chinese, or with a Chinese translation offered. All the documents (including the translation) shall bear the signature/seal of the participant’s person-in-charge. The person-in-charge refers to Commissioner General of Section or his/her authorized representative for official participants, or, Director of Pavilion or his/her authorized representative for other participants. A photocopy of the Letter of Authorization is required for the signature/seal by the authorized representative. The participant shall also provide electric versions of the documents on CD (in PDF or WORD format).
3.2 Issuance of Application Receipt
The Service Center will issue Application Receipt (see Annex III) for application meeting the format requirements. For the disqualified ones, the official participants shall modify or supplement the documents and file the applications again to obtain the Application Receipt.
3.3 On-site verification by the Organizer
The Organizer is entitled to carry out an on-site verification on the actual condition of the performance and complete the On-site Verification Record (see Annex IV). The participants and performers shall provide convenience to the Organizer in terms of easy access, photographing and availability of necessary documents.
Unless otherwise agreed, the documents obtained on site by the Organizer shall be used only for the Performance Certificate application.
In case of any alterations in the name of the performer, the name and venue of performance or lists of programs and corresponding artists, the participant shall submit a statement in written form to the Service Center in a timely manner to facilitate the Organizer’s adjustment. Any statement on alteration in the time of performance must be submitted 15 days prior to the last show of the performance at Expo 2010.
3.4 Issuance of the Performance Certificate
For the participant offering qualified documents and passing the on-site verification, the Organizer will issue the Performance Certificate within 15 days upon the on-site verification. The Organizer will issue one Performance Certificate for each performance for free. The participant shall collect the certificate from the Service Center by presenting the Application Receipt.
4. Application rejection, replacement and replication of the Performance Certificate
The Organizer may reject the issuance of the Performance Certificate if the participant’s application is not qualified and may issue the Notice on Not Issuing Performance Certificate (see Annex V) upon the participant’s request.
In case of loss, the participant may submit a written application to the Service Center for replacement. The Organizer, after receiving and reviewing necessary documents and information, will issue a new certificate, and charge RMB100 for each Performance Certificate.
The performance organizer having obtained the Performance Certificate according to the provisions may replicate the certificate by itself and determine on the measures and standards for distributing the certificate to concerned performers.
The provisions apply to official participants and may be used as reference for UBPA and corporate participants, as well as Hong Kong, Macau and Taiwan.
